Drug offences encompass a wide range of activities, from mere possession to large-scale importation. In the UK, controlled drugs are prohibited by the Misuse of Drugs Act 1971.

The severity of the offence and associated penalties hinge on several factors, including the classification of the drugs involved, the quantity seized, the quality of drugs (relevant in class A substances) and the accused persons alleged role in any drug-related enterprise.

Drug laws encompasses a broad spectrum of drug-related offences, ranging from the simple possession of controlled substances to the more serious crime of possession with intent to supply. These offences are rigorously enforced to prevent the misuse and distribution of controlled drugs, ensuring public safety and compliance with the law.

The severity of the offence and associated penalties hinge on several factors, including the classification of the drugs involved, the quantity seized, the quality of drugs (relevant in class A substances) and the accused persons alleged role in any drug-related enterprise.

To be clear, the following is unlawful:

  • to possess a controlled drug.

  • to possess a controlled drug with intent to supply it.

  • to unlawfully supply (sell/give/share) a controlled drug.

  • to allow premises you occupy or manage to be used for the smoking or use of drugs.

In the UK controlled drugs are widely classified into three categories A, B and C. 

·  Class A drugs are classified as crack cocaine, cocaine, ecstasy (MDMA), heroin, LSD, magic mushrooms, methadone, and methamphetamine (Crystal Meth).

· Class B drugs are classified as amphetamines, barbiturates, cannabis, codeine, ketamine, methylphenidate (Ritalin), synthetic cannabinoids, and synthetic cathinone (e.g., mephedrone, methoxetamine.

·  Class C drugs are classified as Anabolic Steroids, Benzodiazepines (Diazepam), Gamma Hydroxybutyrate (GHB), Gamma-Butyrolactone (GBL), Pierazines (BZP), Khat.

Drug offences can be complex, particularly if suspects are being investigated for possession with intent to supply, conspiracy to supply drugs or drug importation. This is where mobile phone evidence, surveillance, searches of associated premises and cell site evidence can become relevant.
