Arrested - What Next?
An arrest is usually unexpected and confusing particularly if the suspect believes they are innocent. The Police can arrest a suspect for several reasons, but in short, they must have reasonable grounds to believe an offence is about to be committed or has been committed coupled with the necessity to arrest under s.24 Police and Criminal Evidence Act 1984.
A suspect can be legally held up to 24 hours without charge at the Police Station and this can be extended to 36 hours on authority of a Superintendent and further extended upon application by the Police to the Magistrates’ Court which is reserved for the most serious and complex cases.
Whilst in custody detainees have some rights which include informing someone of their detention, having a copy of the Police and Criminal Evidence Act and the right to independent legal advice.
Access to legal advice may be gained via the Legal Aid duty solicitor service provided by the government, a Solicitor of choice who has signed up to the Legal Aid scheme or a private Solicitor who charges a fixed fee such as Kelly Blake Legal.
